1. Acceptance of Terms

By accessing or using the VisaFit, VisaFit Sports, OPT90, StayInTheGame, or related applications, websites, or services operated by Fullmoonstar LLC (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”).

If you do not agree to these Terms, you must not access or use the Service.

2. Description of the Service

The Service provides educational tools, informational guidance, and planning support for international students and professionals exploring career paths and compliance considerations related to Optional Practical Training (OPT) and related programs.

The Service may include, but is not limited to:

  • Career exploration across multiple domains (e.g., sports, STEM, STEAM, business, trades, interdisciplinary roles)
  • Educational explanations of OPT concepts and timelines
  • Role analysis, risk indicators, and framing considerations
  • Resume and positioning guidance (educational only)
  • AI-generated reports, summaries, and planning outputs
  • Administrative dashboards, analytics, and progress tracking

The Service does not provide:

  • Legal advice
  • Immigration advice
  • Job placement or recruiting services
  • Employment guarantees
  • Sponsorship guarantees

Use of the Service does not create an attorney-client, consultant-client, employment, agency, or fiduciary relationship.

3. Educational Use Only — No Legal or Immigration Advice

All content, reports, AI-generated outputs, recommendations, and guidance provided by the Service are for general educational and informational purposes only.

Specifically:

  • We are not a law firm or immigration consultancy
  • We do not provide legal or immigration advice
  • We do not represent users before any government agency
  • We do not guarantee OPT eligibility, approval, compliance, sponsorship, or employment
  • Immigration outcomes depend on individual circumstances and official interpretations

Users are solely responsible for verifying information with:

  • A Designated School Official (DSO)
  • A qualified immigration attorney
  • Official government sources (e.g., USCIS)

4. No Guarantees

We make no representations or warranties regarding:

  • Immigration outcomes or compliance
  • OPT approval, timing, or eligibility
  • Job offers, interviews, or employment outcomes
  • Employer decisions or sponsorship
  • Accuracy, completeness, or currency of third-party or external information

Use of the Service is entirely at your own risk.

5. User Responsibilities

You agree that:

  • Information you provide is accurate to the best of your knowledge
  • You will not rely solely on the Service for legal or immigration decisions
  • You will comply with all applicable laws, regulations, and visa requirements
  • You understand that immigration rules, enforcement practices, and employer standards may change at any time
  • You are responsible for how you interpret and apply any educational guidance provided

6. Payments & Purchases

Certain features of the Service require payment.

  • Payments are processed by third-party providers (such as Stripe)
  • We do not store or process payment card information
  • Access to paid features is granted only after successful payment confirmation

Pricing Changes

We may modify pricing, plans, or included features from time to time.

Any pricing changes apply prospectively only and do not affect completed purchases. Where required, advance notice may be provided through the Service or by email.

7. Refund Policy

Unless otherwise stated:

  • All sales are final once a report or paid feature is generated
  • Refunds may be issued only in cases of verified technical failure
  • Refund requests must be submitted within 24 hours of purchase
  • Refund eligibility is determined at our sole discretion, except where prohibited by law

8. AI-Generated Content

The Service uses artificial intelligence systems to generate educational outputs.

You acknowledge that:

  • AI-generated content may contain errors, omissions, or inaccuracies
  • AI outputs are not authoritative and may vary between runs
  • AI outputs do not replace professional, legal, or immigration advice
  • You remain responsible for evaluating, verifying, and using AI-generated content

We do not guarantee consistency, completeness, or suitability of AI outputs for any specific purpose.

9. Fair Use, Service Limits & Availability

To ensure system stability, cost control, and abuse prevention, we may apply reasonable limits, throttling, or restrictions on features, including but not limited to report generation, AI usage, exports or downloads, and access frequency.

These limits may vary by plan, usage patterns, system capacity, or security considerations and may be applied without prior notice.

We reserve the right to modify, suspend, or discontinue any feature or portion of the Service at any time.

10. Communications & Notifications

Transactional Communications

We may send service-related communications necessary to operate the Service, including:

  • Account notifications
  • Authentication or security messages
  • Receipts and payment confirmations
  • Report availability notices
  • Progress reminders related to actions you initiated

These communications are considered transactional and may be sent regardless of marketing preferences.

Marketing Communications

Marketing or promotional communications (such as feature announcements, discounts, or new product launches) will be sent only if you have explicitly opted in. You may opt out at any time.

11. Analytics, Monitoring & Administration

To operate and improve the Service, we may collect and review limited usage and activity signals, including feature usage, draft reports and completions, purchases and checkout events, and system and security events.

These signals are used for:

  • Service operation and troubleshooting
  • Abuse prevention and fraud detection
  • Product improvement and analytics

We do not monitor private user content beyond what is necessary to provide the Service.

12. Account Suspension & Termination

We reserve the right to suspend or terminate access to the Service, with or without notice, for:

  • Abuse or excessive usage
  • Misuse of the Service
  • Violation of these Terms
  • Fraudulent, deceptive, or manipulative activity
  • Actions that compromise platform security or integrity

Termination does not entitle users to refunds unless required by law.

13. Limitation of Liability

To the maximum extent permitted by law, the Service and its operators shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to:

  • Loss of immigration status
  • Missed deadlines or compliance issues
  • Loss of employment opportunities
  • Loss of income, data, or business opportunities

Your sole remedy for dissatisfaction with the Service is to discontinue use.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to conflict-of-law principles.
